Terms of Use

These Terms of Use govern your access to and use of Aurelua ("Aurelua", "we", "us"), a marketplace platform operated from the Republic of South Africa. By creating an account or transacting on our platform, you agree to these Terms.

1. About Aurelua

Aurelua is a marketplace platform that lets independent sellers ("Sellers") publish online storefronts and accept orders from buyers ("Buyers"). We are not the seller of any goods listed by Sellers; we are an intermediary that facilitates listing, ordering, payment, and dispute resolution.

Aurelua is registered as Aurelua (registration number 2026/344331/07) in South Africa.

2. Eligibility

  • You must be at least 18 years of age to register an account or place an order.
  • You must provide truthful, current, and complete information when registering.
  • You may not use Aurelua if you have previously been suspended or barred from the platform.
  • Sellers must be legally able to sell the goods they list under South Africa law.

3. Your account

You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at info@aurelua.com if you suspect unauthorised access.

4. Buyer terms

4.1 Orders form a contract with the Seller

When you place an order, you enter into a sale contract directly with the Seller of the listed goods. Aurelua processes the payment and coordinates fulfilment, but is not a party to the underlying sale contract.

4.2 Pricing and totals

All prices on Aurelua are displayed in South African Rand (ZAR) and inclusive of any applicable taxes unless explicitly stated otherwise. At checkout, you will see the line items, delivery fee, and platform fee that make up the total payable.

4.3 Cooling-off and refunds

Buyers' rights under the Consumer Protection Act 68 of 2008 are described in our Refund Policy, which forms part of these Terms.

5. Seller terms

5.1 Listings and accuracy

  • You may only list goods you have the legal right to sell.
  • Product descriptions, photos, prices, and stock levels must be accurate and not misleading.
  • You are responsible for ensuring that your listings comply with South Africa consumer law.

5.2 Fulfilment

Sellers are responsible for fulfilling confirmed orders within the delivery timeframe communicated to the Buyer, and for handling returns in line with our Refund Policy.

5.3 Platform fees

Sellers pay a platform fee on completed orders. Current fees are published on our Pricing page. Fees are deducted before payout. Aurelua may change platform fees with at least 30 days' written notice (via email) to active Sellers.

5.4 Payouts

Sellers receive payouts according to the schedule on the Pricing page. Sellers are responsible for any taxes due on income earned through the platform.

6. Acceptable use

You may not use Aurelua to:

  • List or order goods that are unlawful in South Africa (firearms without proper licensing, controlled substances, counterfeit goods, stolen goods, etc.).
  • List goods that infringe a third party's intellectual property rights.
  • Engage in fraudulent, deceptive, or abusive conduct.
  • Circumvent the platform's payment systems (e.g. directing Buyers to off-platform channels to avoid fees once an order has been placed on Aurelua).
  • Transmit malware, scrape the platform, or attempt to disrupt our services.

Aurelua may suspend or terminate any account that violates these rules, with or without prior notice depending on the severity of the breach.

7. Payments and disputes

Card and EFT payments are processed by third-party payment providers (currently Paystack and Ozow). Aurelua does not store full card details. Where applicable, funds are held in escrow until delivery is confirmed or a dispute is resolved.

Disputes between Buyers and Sellers should first be raised with the other party via the order's chat thread. If the parties cannot resolve the dispute, either party may escalate to Aurelua via info@aurelua.com. Our team reviews escalations on the basis of the order record, communications, and any evidence supplied. Our decision is binding for the limited purpose of how Aurelua handles platform-held funds; it does not limit either party's rights to pursue remedies under South Africa law.

8. Intellectual property

Aurelua's logos, design, copy, and software are owned by Aurelua and protected by intellectual-property laws. Sellers retain ownership of their own content (logos, photographs, descriptions) and grant Aurelua a worldwide, non-exclusive, royalty-free licence to display, reproduce, and distribute that content for the purpose of operating the platform.

9. Service availability

We aim to keep Aurelua available and reliable, but we provide the platform on an "as is" and "as available" basis. We do not guarantee uninterrupted availability and we may suspend access for maintenance, security, or operational reasons.

10. Limitation of liability

To the maximum extent permitted by law, Aurelua's aggregate liability for any claim arising from your use of the platform is limited to the platform fees paid by you to Aurelua in the 12 months preceding the event giving rise to the claim. Aurelua is not liable for the acts or omissions of Buyers, Sellers, or third-party service providers. Nothing in these Terms limits your rights under sections of the Consumer Protection Act that may not be excluded by contract.

11. Indemnity

You agree to indemnify Aurelua against any claims arising from your listings, your sales, your purchases, or your breach of these Terms, except to the extent caused by Aurelua's own negligence or wilful misconduct.

12. Termination

You may close your account at any time by contacting info@aurelua.com. Aurelua may suspend or terminate accounts for breach of these Terms. On termination, certain obligations survive — including outstanding payment obligations, dispute-resolution obligations, indemnities, and limitation of liability.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email to the address on your account at least 14 days before they take effect. Continued use of Aurelua after the effective date constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute that cannot be resolved informally will be submitted to the courts of South Africa with appropriate jurisdiction.
